TERMS OF SERVICE

These Terms govern access to and use of artesaniasjimenez.com.mx and purchases made directly with Artesanías Jiménez through the website, email, WhatsApp, telephone, quotation or other electronic means.

By using the site or making a purchase, the customer accepts these Terms, the Privacy Policy, the Shipping Policy and the Returns and Refunds Policy.

1. ONLINE-ONLY OPERATION

Artesanías Jiménez operates exclusively through e-commerce and shipments by parcel carrier.

We do not have a physical store, showroom, counter, in-person service center or pickup point.

For security reasons:

• We do not receive visits.
• We do not make personal deliveries.
• We do not accept cash payments.
• Merchandise may not be picked up directly.
• We do not accept in-person returns.
• We do not publish the locations of workshops, warehouses or inventory.

All clarifications, claims, exchanges and returns are handled through the official electronic channels.

1. CAPACITY OF THE BUYER

The buyer declares:

• To be of legal age.
• To have legal capacity to enter into contracts.
• To provide truthful and up-to-date information.
• To be the holder or an authorized user of the payment method.
• To have authorization when acting on behalf of a church, company, parish, institution or third party.

It is prohibited to use identities, addresses, cards or accounts belonging to others without authorization.

1. PRODUCT INFORMATION

Artesanías Jiménez endeavors to display clear information about:

• Dimensions.
• Materials.
• Finishes.
• Quantities.
• Use.
• Price.
• Availability.

Photographs are representative.

Due to handcrafted manufacturing and screen settings, reasonable variations in tone, texture, shine or finish may exist.

The customer must review the written dimensions before buying. Photographs must not be used to calculate dimensions when the listing or quotation contains express measurements.

In the event of a contradiction, the written specifications confirmed in the order or quotation will prevail.

1. HANDCRAFTED NATURE

Some of the products are manufactured, hammered, cast, welded, polished, assembled, patinated or decorated by hand.

The small differences inherent to these processes do not necessarily constitute a defect.

Metals may change tone, darken, oxidize or develop a patina over time.

1. AVAILABILITY

Adding a product to the cart does not guarantee that it is reserved.

Availability may change before payment and order review are completed.

When a product is not available, we may:

• Propose a manufacturing timeframe.
• Offer an alternative.
• Cancel the transaction and refund the amount charged.

We will not ship a different product without the customer's authorization.

1. RECEIPT AND ACCEPTANCE OF THE ORDER

An automatic confirmation indicates that the system received the order, but not necessarily that the order has already been accepted for preparation or shipping.

Before preparing the order we may verify:

• Payment.
• Availability.
• Price.
• Address.
• Coverage.
• Fraud risk.
• Manufacturing feasibility.
• Specifications.

The order may be cancelled before shipping when there is:

• Lack of inventory.
• Impossibility of manufacture.
• An obvious error in price or description.
• An address without coverage.
• False or inconsistent information.
• Reasonable suspicion of fraud.
• Rejection or reversal of payment.
• Legal impossibility of completing the transaction.

In that case, the amount actually charged will be refunded.

1. PRICES

Prices are displayed in the currency indicated in the store.

Before paying, the customer may review the subtotal, shipping, taxes, discounts and total.

Quotations may have limited validity due to variations in:

• Metals.
• Materials.
• Labor.
• Transport.
• Exchange rate.

The quoted price will be maintained only during its period of validity and after receipt of the payment or deposit indicated.

1. OBVIOUS ERRORS

When there is a manifest error of data entry, price, description, availability or calculation that reasonably does not correspond to the product offered, Artesanías Jiménez may inform the customer before shipping.

The customer may accept the correct conditions or cancel the transaction and receive the corresponding refund.

This provision does not allow orders that have been validly accepted to be modified arbitrarily.

1. PAYMENTS

The customer authorizes the charge corresponding to their order.

Payments may be processed through Shopify, financial institutions, PayPal or other external providers.

A transfer receipt does not replace the effective crediting of the funds.

The order will not be considered paid until the amount has been confirmed.

1. FRAUD PREVENTION

Artesanías Jiménez may use automated tools and manual reviews to detect risky transactions.

We may request:

• Confirmation of identity.
• Ownership of the payment method.
• Confirmation of the address.
• Telephone and email.
• Proof of payment.
• Authorization from the cardholder.
• Identification of the authorized recipient.
• Reasonably necessary information.

The order may be held while verification is carried out.

When there are substantial inconsistencies or the customer does not provide sufficient information, the transaction may be cancelled and refunded before shipping.

We will never ask for banking passwords, PINs, dynamic codes or the full CVV code.

1. CUSTOMIZED PRODUCTS

Any product is considered customized if it:

• Is manufactured especially.
• Changes in size, material, color or finish.
• Includes a name, date, text, logo, coat of arms or engraving.
• Is modified according to a photograph or drawing.
• Requires materials purchased especially.
• Is not part of the regular inventory.

The customer is responsible for confirming:

• Dimensions.
• Spelling.
• Names.
• Dates.
• Symbols.
• Proportions.
• Colors.
• Finishes.
• Intended use.
• Compatibility with the installation site.

Approvals sent by WhatsApp, email or another electronic means will be considered evidence of agreement.

After approval, any modification may change the price and the timeframe.

Artesanías Jiménez will not be responsible for errors present in texts, designs or dimensions expressly approved by the customer.

1. PHOTOGRAPHS, DRAWINGS AND DESIGNS

When the customer provides photographs, drawings, logos or designs, they declare that they have authorization to use them.

Reproductions that infringe third-party rights must not be requested.

Artesanías Jiménez may reject requests that reasonably appear to be unlawful.

Reference photographs will be used as guidance and do not imply an obligation to produce an identical copy, unless the characteristics have been expressly confirmed.

1. PRODUCTION

Manufacturing times are estimates and may change due to:

• Complexity.
• Availability of materials.
• Requested changes.
• Late approvals.
• Casting.
• Drying.
• Polishing.
• Patination.
• Electroplating.
• Circumstances beyond reasonable control.

When there is a relevant change, the customer will be informed.

1. SHIPPING

Orders are subject to the Shipping Policy.

The customer must provide a complete, correct and accessible address.

Installations, maneuvering, cranes, connections, construction work and assembly are not included, unless agreed in writing.

For large or heavy pieces, delivery may be made curbside or at a terminal, depending on the service contracted.

1. RETURNS AND REFUNDS

Cancellations, exchanges, returns and refunds are subject to the Returns and Refunds Policy, without prejudice to the consumer's mandatory rights.

In-person returns are not accepted.

When a return is applicable, instructions will be provided to send it by parcel carrier to the authorized center.

1. USE, INSTALLATION AND MAINTENANCE

The buyer must use, install, clean and maintain the products appropriately.

Artesanías Jiménez will not be responsible for damage caused by:

• Incorrect installation.
• Use other than that advertised.
• Impacts or falls.
• Excessive humidity.
• Fire or heat applied incorrectly.
• Chlorine, acids, solvents or abrasives.
• Lack of maintenance.
• Modifications carried out by third parties.
• Incorrect electrical connections.
• Overloading or unauthorized adaptation.

1. INTELLECTUAL PROPERTY

The texts, photographs, videos, catalogs, designs, logos and graphics belong to Artesanías Jiménez or are used with authorization.

It is prohibited to:

• Copy content for commercial purposes.
• Extract information in bulk.
• Publish photographs as one's own.
• Use designs to manufacture imitations.
• Modify logos or trademarks.
• Create sites or profiles that cause confusion.

1. PROHIBITED USES

It is prohibited to:

• Use the store for fraudulent purposes.
• Impersonate identities.
• Provide false information.
• Attempt to breach systems.
• Introduce malicious code.
• Use stolen payment methods.
• Submit false claims.
• Manipulate evidence or tracking.
• Return different items.
• Obtain duplicate compensation.
• Request private business locations.
• Appear without authorization at workshops or warehouses.

Artesanías Jiménez may restrict accounts, cancel orders and preserve evidence when there is a reasonable suspicion of fraud or abuse.

1. CHARGEBACKS

Before initiating a chargeback, we recommend contacting Artesanías Jiménez to try to resolve the case, without limiting the customer's legal rights.

A chargeback does not authorize keeping both the product and the amount paid at the same time.

When there is a dispute, we may provide evidence related to:

• Purchase.
• Payment.
• Acceptance of policies.
• Communications.
• Address.
• Tracking.
• Signature or proof of delivery.
• Photographs and packing video.

If a refund or replacement has already been granted, the customer must inform their bank to avoid duplicate compensation.

1. ELECTRONIC COMMUNICATIONS

The customer accepts that confirmations, approvals, invoices, notices, policies and tracking labels may be sent electronically.

Records from Shopify, email, WhatsApp, payment providers and parcel carriers may be used as evidence to the extent permitted by law.

1. THIRD-PARTY SERVICES

The store uses Shopify and external providers for:

• Hosting.
• Payments.
• Security.
• Analytics.
• Communications.
• Shipping.

Artesanías Jiménez does not have full control over the availability or decisions of banks, parcel carriers and platforms.

This does not eliminate the obligations that legally correspond to Artesanías Jiménez.

1. SITE AVAILABILITY

The site may experience interruptions due to maintenance, updates, technical failures or causes beyond our control.

A temporary interruption does not eliminate obligations relating to orders previously accepted.

1. FORCE MAJEURE

A delay caused by unforeseeable or unavoidable events beyond our reasonable control will not be considered a breach, such as:

• Natural disasters.
• Blockades.
• Accidents.
• Conflicts.
• Restrictions imposed by authorities.
• General transport disruptions.
• Extraordinary shortages of materials.
• General service failures.

Where possible, we will inform the customer and propose a reasonable solution.

1. LIMITATION IN ACCORDANCE WITH THE LAW

Nothing in these Terms is intended to exclude liabilities that cannot legally be limited.

To the maximum extent permitted, Artesanías Jiménez will not be liable for indirect losses or damages arising from acts of third parties or causes not attributable to it.

1. MODIFICATIONS

These Terms may be updated for future transactions.

The applicable version will be the one published at the time of purchase, except for modifications that are favorable or legally required.

1. PARTIAL INVALIDITY

If a provision is considered invalid or unenforceable, it will be adjusted only to the extent necessary.

The remainder of the Terms will remain in force.

1. GOVERNING LAW

These Terms are interpreted in accordance with the laws of the United Mexican States.

The consumer may raise clarifications with Artesanías Jiménez and may approach the Procuraduría Federal del Consumidor (Federal Consumer Protection Agency) or the competent authorities.

Nothing requires the consumer to waive rights to which they are legally entitled.
